特許表示の意味について

1．相談の内容
クライアントは、新規に開発した化学物質について、特許権を取得したいと考え、弊所に相談されました。
2．解決策
特許庁の特許情報プラットフォームJ-PlatPatを用いて、先行技術文献調査を行いました。その結果、当該化学物質に類似する特許文献がありました。一方、クライアントは当該化学物質を、この類似文献とは別の目的のために使用することを考えており、効果や機能において新規性があるかを調べました。その結果、当該物質をこの目的のために使用することや、その効果について記載のある別の特許文献が見つかったため、効果や機能という観点においても新規性や進歩性が無く、特許権の取得は難しいと判断しました。

引用発明と比較した有利な効果が、技術水準から予測される範囲を超えた顕著なものであることにより、進歩性が否定されないこともある。例えば、引用発明特定事項と請求項に係る発明の発明特定事項とが類似していたり、複数の引用発明の組み合わせにより、一見、当業者が容易に想到できたとされる場合であっても、請求項に係る発明が、引用発明と比較した有利な効果であって引用発明が有するものとは異質な効果を有する場合、あるいは同質の効果であるが際だって優れた効果を有し、これらが技術水準から当業者が予測することができたものではない場合には、この事実により進歩性の存在が推認される。
3．結論
類似の化学物質が既に存在していても、それを使用する目的が異なったり、その効果が異質であったり、同質ではあっても優れた効果を有する場合には、新規性や進歩性が生じる場合もあります。弊所では、特許取得のための先行技術文献調査を行っております。お気軽にご相談ください。

1. Content of the consultation
The client consulted us because he wanted to obtain a patent for a newly developed chemical substance.
2. Solution
We conducted a prior art literature search using the Japan Patent Office's patent information platform J-PlatPat. As a result, we found a patent document similar to the chemical substance in question. However, the client was considering using the chemical substance for a purpose other than the similar document, and investigated whether it had novelty in terms of effect or function. As a result, we found another patent document that described the use of the substance for this purpose and its effect, so we determined that there was no novelty or inventive step in terms of effect or function, and that it would be difficult to obtain a patent.

In some cases, inventive step is not denied because the advantageous effect compared to the cited invention is significant beyond the range predicted from the state of the art. For example, even if the matters specifying the cited invention and the matters specifying the claimed invention are similar, or if a person skilled in the art could easily come up with the idea by combining multiple cited inventions, if the claimed invention has an advantageous effect compared to the cited invention and has a different effect from that of the cited invention, or has an effect of the same quality but a remarkably superior effect that a person skilled in the art could not have predicted from the state of the art, the existence of an inventive step is presumed from this fact.
3. Conclusion
Even if a similar chemical substance already exists, if the purpose of its use is different, the effect is different, or the effect is the same quality but superior, novelty and inventive step may arise.
