1．相談の内容
クライアントは、他社が提供する地図データの利用に関して、著作権の対応が分からないとして、弊所に相談されました。
2．解決策
当該他社のウェブサイトを参照し、当該地図データの著作権や利用規約について調べました。その結果、当該地図データを使用する場合には、当該他社のロゴマークや著作権表示が必要であるとの記載がありました。
又、著作権法において、地図には著作権が生じます（著作権法第10条1項6号）。そのため、他社の作成した地図を利用する場合には、著作者の許諾が必要となります。

六 地図又は学術的な性質を有する図面、図表、模型その他の図形の著作物

3．結論
著作権法においては、地図も著作物とされているため、地図の利用に関しては著作権の侵害のおそれがないかを確認する必要があります。又、地図データを提供している企業の利用規約等を参照し、その規約を順守して、地図データを利用する必要があります。

1. Content of the consultation
The client consulted us because he did not know how to handle copyright issues regarding the use of map data provided by another company.
2. Solution
We looked up the copyright and terms of use for the map data on the website of the other company. As a result, we found that the other company's logo and copyright notice are required when using the map data.
In addition, maps are also copyrighted under the Copyright Act (Article 10, Paragraph 1, Item 6 of the Copyright Act). Therefore, permission from the copyright owner is required when using maps created by other companies.

3. Conclusion
Under the Copyright Act, maps are also considered copyrighted works, so it is necessary to check whether there is a risk of copyright infringement when using maps. In addition, you must refer to and abide by the terms of use of the company providing the map data when using the map data.
