1．相談の内容
クライアントは、開発した安全装置について実用新案登録による保護を検討しており、権利化の可能性を確認するため、当所へご相談いただきました。
2．解決策
当所では、まずクライアントから提供された技術資料を基に、安全装置の構成、動作原理、解決しようとする課題及び得られる効果について詳細なヒアリングを行いました。
その上で、J-PlatPat（特許情報プラットフォーム）を用いて、関連する技術分野の特許文献及び実用新案文献を対象として先行技術調査を実施しました。
調査の結果、対象となる安全装置と同様に、安全性の向上や装置の安定動作を目的とした類似の技術は確認されました。しかし、確認された先行技術文献では、構成要素の配置や各部材の連携関係、動作原理が本件考案とは異なっており、本件考案の特徴的な構成を備えていないことを確認しました。
これらの比較検討に基づき、本件考案は既存技術とは異なる技術的特徴を有しており、新規性を有すると判断しました。また、実用新案登録請求の範囲を作成する際に重要となる構成要件についても整理し、権利化に向けた検討を行いました。

1. Consultation
The client was considering obtaining a utility model right to protect a developed safety device and consulted our firm to assess the possibility of obtaining intellectual property protection.
2. Our Solution
We first conducted detailed interviews with the client based on the technical documents provided, in order to understand the structure of the safety device, its operating principles, the problems it was intended to solve, and the advantages it provided.
We then conducted a prior art search using J-PlatPat (Japan Platform for Patent Information), targeting patent publications and utility model publications in the relevant technical field.
As a result of the search, we identified similar technologies that, like the subject safety device, were intended to improve safety and ensure stable operation of equipment. However, upon reviewing the cited prior art documents, we confirmed that the arrangements of the components, the relationships between the respective elements, and the operating principles differed from those of the subject safety device, and that the prior art did not include the characteristic configuration of the subject safety device.
Based on this comparative analysis, we determined that the subject safety device possessed technical features different from those of the existing technologies and had novelty. We also organized the essential structural elements to be considered when preparing the claims for utility model registration and examined the approach for obtaining intellectual property protection.
3. Conclusion
