1.相談の内容
クライアントは、工業用品に関する2つの発明を行いました。この2つの発明は、主要な構成要件が共通している一方で、発明が奏する作用・効果が異なることから、一つの特許出願にまとめることができるのか、すなわち発明の単一性(特許法第37条)の要件を満たすか判断がつかず、当所にご相談されました。
2.解決策
2つの発明の構成要件を比較・検討したところ、主要な技術的構成は共通しているものの、それぞれが解決しようとする課題や奏する作用・効果には一定の違いが認められました。
もっとも、発明の単一性は、作用・効果が同一であるか否かによって判断されるものではなく、各発明が同一又は対応する特別な技術的特徴(Special Technical Feature:STF)を有し、技術的な関連性を有しているかによって判断されます。ここでいう「特別な技術的特徴」とは、発明の先行技術に対する貢献、すなわち先行技術との対比において発明が有する技術上の意義を明示する技術的特徴を意味します。
本件では、両発明は共通する技術的構成に基づくSTFを有しており、解決しようとする課題にも技術的な関連性が認められることから、作用・効果に相違があるとしても、発明の単一性を満たすと判断しました。
以上から、この2つの発明は一つの特許出願としてまとめて出願することが可能であると判断し、その方針で出願手続きを進めることをご提案しました。
3.結論
複数の発明について一つの特許出願を行うためには、特許法第37条に定める発明の単一性を満たす必要があります。発明の単一性は、作用・効果の一致だけでなく、共通する特別な技術的特徴や技術的関連性を総合的に考慮して判断されます。

1. Consultation
A client developed two inventions relating to industrial products. Although the two inventions share substantially the same technical features, they produce different functions and effects. The client was therefore uncertain whether the inventions satisfy the requirement of unity of invention under Article 37 of the Japanese Patent Act and could be filed together in a single patent application.
2. Solution
We compared and analyzed the technical features of the two inventions. While the inventions share most of their technical features, we confirmed that they achieve different functions and effects.
However, the requirement of unity of invention is not determined solely by whether the inventions produce the same functions or effects. Rather, the key issue is whether the inventions share the same or corresponding Special Technical Feature (STF) and have the required technical relationship.
A Special Technical Feature refers to a technical feature that defines the contribution the invention makes over the prior art—that is, the technical significance of the invention in comparison with the prior art.
In this case, we concluded that the two inventions share the same Special Technical Feature and are technically related in terms of the problems they address. Accordingly, despite the differences in their functions and effects, the inventions satisfy the requirement of unity of invention.
Based on this analysis, we advised that the two inventions could be included in a single patent application.
3. Conclusion
When filing multiple inventions in a single patent application, the inventions must satisfy the requirement of unity of invention under the Japanese Patent Act. Whether this requirement is met depends not only on the functions and effects of the inventions but also on whether they share a common Special Technical Feature and possess the required technical relationship.
