1.相談の内容
クライアントは、自社のサービスについて商標登録出願を行いましたが、商標法第4条第1項第11号(先願に係る他人の登録商標)を理由として拒絶査定を受けました。クライアントの商標は、先行登録商標の文字部分の末尾に数字を付した構成となっていたため、この拒絶査定を覆すことができるかについて、当所へご相談いただきました。
2.解決策
当所では、まず拒絶査定において引用された先行登録商標とクライアントの商標との比較・検討を行いました。クライアントの商標は、先行登録商標の文字部分に数字を付加した構成でした。
そこで、同様の構成を有する商標について、商標審査基準及び過去の審決例を調査しました。
商標審査基準では、商品の規格、品番、形式等を表すものとして認識され得る数字や2文字以下の欧文字は、自他商品・役務識別力を有しないものとして取り扱われる場合があります。そのため、商標中の数字部分は、取引者・需要者に対して商品の型番や品番等を示すものとして認識され、識別力が弱いと判断されることがあります。
また、拒絶査定不服審判の審決例(不服2010-24384、不服2010-20461)においても、「先行登録商標の文字」+「数字」からなる商標については、文字部分と数字部分とが不可分一体に結合しているとはいえず、数字部分も識別力が弱いことから、需要者は主として文字部分に着目して商標を認識すると判断されています。その結果、先行登録商標と類似すると判断され、拒絶査定が維持されています。
本件についても、クライアントの商標は文字部分と数字部分とが不可分一体に結合したものとは認められず、数字部分も商品の規格や品番等を表示するものとして認識される可能性が高いことから、商標の要部は文字部分であると判断されると考えられます。そのため、先行登録商標との類否判断において両商標が類似するとした拒絶査定は妥当であり、拒絶査定不服審判を請求しても判断を覆すことは容易ではないと判断しました。
3.結論
商標登録出願を行う際には、あらかじめ先行登録商標の調査を実施し、類似する商標が存在しないかを確認することが重要です。特に、先行登録商標に単に数字を付加しただけの商標は、数字部分の識別力が弱いと判断されることが多く、先行登録商標と類似すると判断される可能性があります。
そのため、新たな商標を採択する際には、数字を付加するだけではなく、商標全体として十分な識別力を備えているかを検討することが望まれます。

第四条次に掲げる商標については、前条の規定にかかわらず、商標登録を受けることができない。

1. Consultation
The client filed a trademark application for its service in Japan. However, the application received a decision of refusal on the grounds of Article 4(1)(xi) of the Japanese Trademark Act, which prohibits the registration of trademarks that are identical or similar to an earlier registered trademark owned by another party.
The client's trademark consisted of the wording of the cited prior registered trademark with a numerical suffix added at the end. The client therefore sought our advice as to whether the decision of refusal could be successfully overturned.
2. Our Solution
We first compared the cited prior registered trademark with the client's trademark as identified in the decision of refusal. The client's mark consisted of the wording of the earlier registered trademark together with an added numeral.
We then reviewed the Trademark Examination Guidelines and past appeal decisions involving trademarks of a similar structure.
According to the Trademark Examination Guidelines, numerals and one- or two-letter alphabetic characters that are likely to be recognized merely as indicating a product specification, model number, serial number, or similar designation may be regarded as lacking distinctiveness. As a result, the numerical portion of a trademark is often considered to have only weak source-identifying significance.
In addition, previous appeal decisions (Appeal Nos. 2010-24384 and 2010-20461) have held that trademarks consisting of the wording of a prior registered trademark followed by a numeral are similar to the prior registered trademark where the wording and numeral are not inseparably combined and the numeral itself has little or no distinctiveness. In such cases, consumers are considered to focus primarily on the wording of the trademark, and the decision of refusal has therefore been upheld.
Applying these principles to the present case, we concluded that the wording and numeral in the client's trademark would not be regarded as forming an inseparable unit. Furthermore, the numeral would likely be understood merely as indicating a model number or similar designation and would therefore have weak distinctiveness. Consequently, the dominant portion of the client's trademark would be considered to be the wording itself. On this basis, we concluded that the Japan Patent Office's finding that the two trademarks are similar was reasonable and that it would be difficult to overturn the decision of refusal through an appeal.
3. Conclusion
Before filing a trademark application, it is important to conduct a clearance search to determine whether similar prior registered trademarks already exist. Simply adding a numeral to an existing trademark is often insufficient to distinguish the mark, since the numeral may be regarded as having little distinctiveness. As a result, the trademark may still be considered similar to the earlier registered trademark.
When selecting a new trademark, applicants should therefore consider not only adding numbers or other minor elements but also ensuring that the trademark as a whole possesses sufficient distinctiveness.
