1. Consultation
The client had developed a new chemical substance and was considering obtaining patent protection for the invention. However, the client was unsure what types of technical materials and experimental data should be prepared before filing a patent application and therefore sought our advice.
2. Our Solution
We first conducted a prior art search relating to the chemical substance and reviewed patent applications and granted patents in the relevant technical field. Based on our analysis, we concluded that, in the field of chemical inventions, it is important to prepare sufficient technical materials to support both the invention itself and its advantageous effects.
Specifically, we advised that the patent specification should include illustrations of the chemical substance (such as chemical structural formulas), together with sufficient technical information to enable the invention to be reproduced. This includes the manufacturing process, reaction conditions (such as temperature, pressure, and reaction time), as well as formulation ratios, concentrations of raw materials, and other relevant process parameters.
We also recommended obtaining experimental data based on working examples and comparative examples in order to objectively demonstrate the usefulness and superior effects of the invention compared with conventional technologies or comparative materials. Such experimental data can serve as persuasive evidence when establishing patentability, particularly with respect to inventive step and compliance with the support requirement.
Furthermore, we advised the client to organize the necessary technical data before filing and to prepare a patent specification that would facilitate responses to any future Office Actions. This approach helps maximize the likelihood of obtaining broad and robust patent protection.
