1．相談内容
クライアントは、新たに開発した画像認識システムについて、特許権を取得したいと考え、当所へご相談されました。
2．解決策
まず、特許庁が提供するJ-PlatPat（特許情報プラットフォーム）を利用し、画像認識に関連する技術分野について、先行特許文献の調査を実施しました。
クライアントの画像認識システムは、機械学習を用いて特定の物体画像を認識するシステムですが、先行技術文献においても、同様に機械学習を用いて当該物体の画像を認識するシステムが複数件確認されました。
また、機械学習を用いる工程以外の部分についても、画像認識分野において周知技術であることが確認されました。
そのため、クライアントの画像認識システムが特許権を取得するためには、機械学習における具体的な学習モデルや学習データ、又は機械学習を用いる工程以外の部分に、新規性又は進歩性が認められる必要があると考えられます。

1. Consultation Details
The client consulted our office regarding obtaining a patent for a newly developed image recognition system.
2. Solution
First, we conducted a prior art search in technical fields related to image recognition using J-PlatPat (Japan Platform for Patent Information) provided by the Japan Patent Office.
The client’s image recognition system uses machine learning to recognize images of specific objects. However, the prior art search revealed multiple patent documents disclosing systems that similarly use machine learning to recognize images of the same objects.
In addition, the portions other than the machine-learning process were also confirmed to be well-known technologies in the field of image recognition.
Therefore, in order for the client’s image recognition system to obtain patent protection, it is considered necessary that novelty or inventive step be recognized in the specific learning model, training data, or portions other than the machine-learning process.
3. Conclusion
In recent years, systems and services utilizing AI have become widespread. To obtain patent protection for AI-related technologies, it is important to demonstrate novelty or inventive step in unique learning models, training data, or processes other than the AI-related portions.
