株式会社A社様より、製品Bの名称「C」について、商標登録の可能性の調査についてご相談をいただきました。
2．解決策
ご相談内容を踏まえ、特許情報プラットフォーム（J-PlatPat）を用いて、製品Bの名称「C」に関して、製品Bに対応する商標類似検索および称呼検索を実施いたしました。尚、製品Bは区分Xであることを確認しました。
その結果、名称「C」について商標検索を行ったところ、同一または類似する先行登録商標は確認されませんでした。さらに、称呼類似検索を実施した結果、区分Yにおいて類似の称呼を有する名称「D」の先行登録商標が確認されました。
しかしながら、名称「C」がカタカナ表記であるのに対し、名称「D」は漢字表記であり、外観上の差異が認められること、両名称の観念が異なること、指定商品・役務の区分が、名称「C」は区分X、名称「D」は区分Yと異なること、以上の点を総合的に勘案し、名称「D」が本件における拒絶理由となる可能性は低いものと判断いたしました。
その後、名称「C」に係る商標登録出願書類の作成・検討を行いました。

Review of Trademark Registration Application Documents
1. Consultation Details
Company A consulted us regarding the possibility of trademark registration for the name "C" of product B.
2. Solution
Based on the consultation details, we conducted a trademark similarity search and a pronunciation search for the name "C" of product B using the Japan Patent Information Platform (J-PlatPat). We confirmed that product B belongs to class X.
As a result, a trademark search for the name "C" found no identical or similar prior registered trademarks. Furthermore, a pronunciation similarity search revealed a prior registered trademark for the name "D" with a similar pronunciation in class Y.
However, considering the visual difference between the two names (name "C" is written in katakana, while name "D" is written in kanji), the differing concepts behind the two names, and the different classifications of designated goods/services (name "C" is in class X, name "D" is in class Y), we determined that the likelihood of name "D" being a ground for rejection in this case is low.
Subsequently, we prepared and reviewed the trademark registration application documents related to name "C".
