1．相談内容
クライアントは、食品の商品に使用する商標について、商標登録を受けたいと考え、当所にご相談されました。
2．解決策
当所では、まず当該商標について使用予定の商品内容を確認し、適切な指定商品及び区分を検討しました。その上で、類似商品・役務審査基準に基づき、候補となる指定商品を抽出しました。
次に、特許情報プラットフォーム（J-PlatPat）を用いて先行登録商標の調査を行い、候補となる指定商品や類似群コードと重複する先行登録商標の有無を確認しました。また、過去の拒絶理由通知の内容等も参照し、当該商標が商標法第3条及び第4条の要件を満たすか否かについて検討しました。
これらの調査及び検討の結果、当該商標については、適切な指定商品を設定することで商標登録を受けられる可能性が高いと判断しました。そこで、当該商標及び候補となる指定商品に基づき、商標登録出願書類の作成の検討を行いました。

1. Consultation Details
The client consulted our firm regarding obtaining trademark registration for a mark to be used on food products.
2. Solution
First, our firm reviewed the products on which the trademark was intended to be used and examined the appropriate designated goods and classification. Based on the Examination Guidelines for Similar Goods and Services, we identified candidate designated goods.
Next, we conducted a prior trademark search using the Japan Platform for Patent Information (J-PlatPat) to determine whether any prior registered trademarks existed that overlapped with the candidate designated goods or similar group codes. We also reviewed past office actions and examined whether the trademark satisfied the requirements for registration under Articles 3 and 4 of the Trademark Act.
As a result of these investigations and legal analyses, we determined that the trademark was likely registrable if appropriate designated goods were specified. Accordingly, we prepared the trademark application documents based on the trademark and the candidate designated goods.
3. Conclusion
