1．相談内容
　クライアントは、既に取得している特許技術を応用し、その成分を健康食品に配合することによって新たな用途発明として特許権を取得できないか検討しており、その可能性について当所に相談されました。
　当該技術は既に別の用途に関する特許を取得しているものであり、これを食品に配合することにより、特定の健康効果が得られる可能性があると考えられていました。そのため、当該用途について新たに特許出願を行うことが可能かどうかを検討する必要がありました。

2．解決策
　当所では、まず既存技術の状況を確認するため、特許庁が提供する特許情報プラットフォーム（J-PlatPat）を用いて関連する特許文献の調査を行いました。また、健康食品分野における技術動向を把握するため、インターネット検索による非特許文献調査も併せて実施しました。
　その結果、健康食品の分野では、特定の成分を食品に配合することによって健康維持や体調改善などの作用効果を得る技術が多数提案されていることが確認されました。
　一方、クライアントの提案する用途については、食品に配合した場合に主張されている作用効果が実際に生じるのかについて十分な裏付けが示されておらず、当該用途発明としての効果が認められるかどうかについて不確実性があると考えられました。用途発明では、特定の用途において新たな作用効果が得られることが発明の本質となるため、その効果が合理的に説明できない場合には、特許性が認められない可能性があります。
　そこで当所では、関連する先行特許文献を整理してクライアントに提示するとともに、用途発明として特許出願を検討する場合には、当該食品用途における作用効果について技術的根拠やデータを整理する必要がある旨を説明しました。

3．結論
　先行技術文献調査を行うことで、関連する既存技術を把握するとともに、発明の技術的特徴や特許取得の可能性を検討することができます。また、用途発明の場合には、当該用途における作用効果の裏付けを十分に検討することが重要となります。

1. Consultation Content
The client was considering whether they could obtain a patent for a new use invention by applying an already patented technology and incorporating the ingredient into a health food product, and consulted our firm about this possibility.
The technology in question had already been patented for a different use, and it was believed that incorporating it into food products could potentially provide specific health benefits. Therefore, it was necessary to consider whether it would be possible to file a new patent application for this use.

2. Solution
To confirm the status of existing technology, our firm first conducted a search of related patent documents using the Patent Information Platform (J-PlatPat) provided by the Japan Patent Office. We also conducted an internet search of non-patent literature to understand technological trends in the health food field.
As a result, we confirmed that numerous technologies have been proposed in the health food field that achieve health maintenance, physical condition improvement, and other benefits by incorporating specific ingredients into food products.
However, the client's proposed use did not provide sufficient evidence that the claimed effects would actually occur when the ingredient was incorporated into food products, and we considered there to be uncertainty as to whether the use invention would be recognized as effective. For use inventions, the essence of the invention lies in the achievement of a new effect in a specific use. Therefore, if that effect cannot be reasonably explained, the invention may not be patentable.
Our firm therefore organizes relevant prior patent documents and presents them to our clients. We also explain that when considering a patent application for a use invention, it is necessary to compile technical evidence and data on the effect in the food use in question.

3. Conclusion
Conducting a prior art literature search allows us to understand related existing technology and consider the technical features of the invention and the likelihood of obtaining a patent.
