1．相談内容
クライアントは、新規に発明した日用品について特許権を取得したいと考え、その可能性について当所に相談されました。
2．解決策
当所では、まず特許庁の特許情報プラットフォーム（J-PlatPat）を用いて、関連する先行特許文献の調査を行いました。その結果、クライアントの発明と類似する日用品に関する先行特許文献が複数見つかりました。
一方で、クライアントの発明した日用品には、ユーザの体の寸法や形状を測定し、その測定結果に基づいて最適なパーツを選択するという構成が含まれていました。このようなユーザの身体情報を測定し、その結果に基づいて部品を選択する仕組みは、調査した先行特許文献には記載されていませんでした。
そのため、当該構成は先行技術との差異として認められる可能性があり、クライアントの発明は新規性を有する可能性があると考えられました。また、この相違点について当業者が容易に想到できたかどうかを検討した結果、進歩性についても認められる可能性があると考えられました。
3．結論
先行技術文献調査を行うことで、関連する既存技術の内容を把握するとともに、自身の発明と先行技術との差異を明確にすることができます。また、その結果を踏まえて、発明の新規性や進歩性の可能性を検討することが可能になります。

1. Consultation Content
The client sought to obtain a patent for a newly invented everyday item and consulted our firm regarding the possibility of doing so.
2. Solution
Our firm first conducted a search of relevant prior patent documents using the Japan Patent Office's Patent Information Platform (J-PlatPat). As a result, we found several prior patent documents for everyday items similar to the client's invention.
However, the client's invented everyday item included a mechanism for measuring the user's body dimensions and shape and selecting the optimal parts based on those measurements. This mechanism for measuring the user's physical information and selecting parts based on the results was not described in the prior patent documents we searched.
As a result, we determined that this mechanism could be recognized as a difference from the prior art, and that the client's invention may possess novelty. Furthermore, after examining whether this difference would have been easily conceived by a person skilled in the art, we determined that the inventive step may also be recognized.
3. Conclusion
Conducting a prior art search allows you to understand the content of related existing technology and clarify the differences between your invention and the prior art. Based on the results, it becomes possible to evaluate the novelty and inventive step of the invention.
