商標の登録について

1．相談の内容
A社が商標を発案し、それらの商標が登録できるかどうかのご相談がありました。

2．解決策
まず、商標が既に登録されていないかを確認するために商標検索を行い、同一または類似の商標が存在しないかを調査しました。また、商標をどのような商品やサービスに使用するかを伺い、商標の指定商品・指定役務（区分）を明確にし、確認を行いました。その結果、希望された商標が既に拒絶査定を受けておりました。これは、商標が普通名称として評価されたものと考えられます。商標が普通名称化すると、その商標権の行使が難しくなり、第三者による、使用を止めることが出来なくなります。
また、この商標に他の言葉を付けて、商標申請ができるかどうかも併せてご相談がありました。しかしながら、今回の場合、単に普通名称に1つの言葉を付けるだけでは識別力が不足する可能性があるため、識別力を高めるためには2つ以上の言葉を組み合わせることや、独自の言葉を組み合わせた変更をして、検討することをお勧めしました。

3．結論

Regarding trademark registration

1.Content of the consultation: Company A has proposed trademarks and was consulting us about whether or not those trademarks can be registered.

2. Solution
First, we conducted a trademark search to confirm whether the trademark had already been registered, and investigated whether there were any identical or similar trademarks. We also asked what kind of products or services the trademark would be used for, and clarified and confirmed the designated goods and services (classification) of the trademark. As a result, we found that the desired trademark had already received a rejection decision. This is thought to be because the trademark was evaluated as a generic name. When a trademark becomes a generic name, it becomes difficult to exercise the trademark right, and it becomes impossible to stop third parties from using it.
We were also asked whether it would be possible to apply for a trademark by adding other words to this trademark. However, in this case, simply adding one word to the generic name may not be distinctive enough, so we recommended that in order to increase the distinctiveness, we consider combining two or more words or making changes to combine unique words.
