1．相談内容
　クライアントは、新規に開発したシステムについて特許権の取得を希望され、当所にご相談されました。

2．解決策
　当所では、まず特許情報プラットフォーム（J-PlatPat）やウェブ検索を用いて先行技術調査を行い、当該システムに関連する既存技術を確認し、新規性および進歩性の有無について検討しました。その結果、当該システムには先行技術との差異となる技術的特徴が認められ、特許権の取得を目指すことが可能であると判断しました。
　次に、クライアントから提供されたシステムの概要資料や、開発中のユーザインターフェースの画像等を基に、発明の技術的特徴を整理し、特許請求の範囲および明細書の検討を行いました。
　システムに関する発明では、単にソフトウェアの処理手順や機能のみを説明するだけでは足りず、その処理がコンピュータのハードウェア資源を用いてどのように実現されるかを具体的に示すことが重要です。そこで、本件では、サーバや端末装置などの装置構成を前提として、CPU（プロセッサ）、メモリ、記憶装置、通信部、表示部等のハードウェア構成要素を明確にした上で、これらのハードウェアがプログラムを実行することによりどのような情報処理が実現されるのかを整理しました。
　具体的には、CPUがメモリに記憶されたプログラムを実行することにより、データの取得、情報の演算処理、結果の記憶、ネットワークを介したデータ通信、及び表示部への出力等の処理が行われる構成として説明しました。また、本件システムは複数の装置がネットワークを介して連携する構成であるため、サーバ、端末装置、外部機器などの各装置の役割を整理するとともに、どの装置においてどの処理が実行されるのかを明確にしました。さらに、装置間で送受信されるデータの流れを整理し、システム全体としての情報処理の流れが理解できるように構成しました。
　これらの整理に基づき、発明の要点が適切に表現されるよう、装置発明、方法発明、及びプログラム発明の各観点から特許請求の範囲を検討し、明細書においてもハードウェア資源とソフトウェア処理との関係が明確になるよう明細書の検討を行いました。

3．結論

1. Consultation
The client consulted our firm regarding the acquisition of a patent right for a newly developed system.

2. Solution
First, we conducted a prior art search using the Japan Platform for Patent Information (J-PlatPat) and web searches in order to identify existing technologies related to the system and to examine whether the invention satisfied the requirements of novelty and inventive step. As a result of the investigation, we confirmed that the system included technical features distinguishing it from the prior art and concluded that obtaining patent protection would be feasible.
Next, based on the system overview materials and images of the user interface under development provided by the client, we organized the technical features of the invention and examined the claims and the specification.
For inventions relating to systems, it is insufficient to merely describe software processing procedures or functions. It is important to clearly indicate how such processing is realized using computer hardware resources. Accordingly, in this case, we clarified the system configuration including servers and terminal devices, and identified hardware components such as a CPU (processor), memory, storage devices, communication units, and display units. We then organized how information processing is implemented when the program is executed by these hardware components.
Specifically, the specification explains a configuration in which a CPU executes a program stored in memory to perform processes such as data acquisition, information processing and computation, storage of results, data communication via a network, and output to a display unit. In addition, because the system consists of multiple devices cooperating via a network, we organized the roles of each device, such as servers, terminal devices, and external equipment, and clarified which processes are executed by which device. Furthermore, the flow of data transmitted and received between the devices was structured so that the overall information processing flow of the system can be clearly understood.
Based on this analysis, we examined the claims from the perspectives of apparatus claims, method claims, and program claims so that the essential features of the invention would be appropriately expressed. The specification was also reviewed so that the relationship between the hardware resources and the software processing would be clearly described.

3. Conclusion
In order to obtain patent rights, it is essential to conduct a prior art search and examine whether the invention satisfies the requirements of novelty and inventive step. In addition, for system-related inventions, it is necessary to describe the software processing in terms of specific information processing performed in cooperation with hardware resources.
