1．相談内容
クライアントは、新たな計測システムの導入を検討されており、当該システムの実施が他社の権利を侵害するおそれがないか確認したいとのことで、当所へご相談されました。
2．解決策
当所では、特許庁が提供するJ-PlatPat（特許情報プラットフォーム）を利用し、クライアントの計測システムに関連する技術分野について、先行特許文献の調査を実施しました。その結果、当該計測システムと一定程度類似する技術に関する特許文献が複数確認されました。
調査及び検討の結果、クライアントの計測システムに用いられている基本的な技術は既に公知となっており、一方で、他社が取得している特許権については、公知技術に対してさらに構成要件を付加することで進歩性が認められた発明であることが確認されました。
そのため、クライアントが現時点の計測システムを実施することによって、直ちに他社の特許権を侵害する可能性は低いと考えられました。
もっとも、今後、当該計測システムを改良又は機能追加する過程において、他社の特許権との抵触が生じる可能性もあるため、継続的に先行技術文献調査を行うことが重要であると考えられます。

1. Consultation Details
The client was considering the introduction of a new measurement system and consulted our firm to determine whether implementing the system might infringe the rights of other companies.
2. Solution
Our firm conducted a prior art patent search in the technical field related to the client’s measurement system using J-PlatPat (the Japan Platform for Patent Information) provided by the Japan Patent Office. As a result, multiple patent documents relating to technologies that were similar to the client’s measurement system were identified.
Based on our investigation and analysis, we confirmed that the fundamental technologies used in the client’s measurement system were already publicly known. On the other hand, the inventions covered by patents owned by other companies were recognized as inventive because they included additional technical elements beyond the known technologies.
Accordingly, we concluded that the client’s current implementation of the measurement system was unlikely to immediately infringe the patent rights of other companies.
However, as the system is further improved or additional functions are introduced in the future, there remains a possibility that conflicts with third-party patent rights could arise. Therefore, we believe that it is important to continue conducting prior art searches on an ongoing basis.
3. Conclusion
By conducting prior art searches, it is possible to assess in advance whether a technology intended to be implemented may infringe the rights of other parties.
