1．相談の内容
株式会社A社から、取得した日本の特許Bに関して、米国での出願を念頭に置いたIDS翻訳をしてほしいと、お問い合わせがありました。
2．解決策
株式会社A社が取得した特許Bの従来技術の各種特許公報をIDS翻訳しました。IDS翻訳とは、米国特許制度における情報開示陳述（Information Disclosure Statement, IDS）に関連する翻訳のことを指し、米国で特許出願を行う際、出願人は特許性に関わる重要な情報を米国特許商標庁（USPTO）に開示する義務があります。英語ではない文献をIDSとして提出する場合、全文訳又は部分訳が必要となります。保有している特許Bに関して、米国において権利行使をする際にIDSがポイントとなることがあり、IDS翻訳を行うことによって、米国における特許権に係る特許無効審判や、特許異議申し立て、侵害訴訟などの法的リスクを軽減し、特許権の有効性を保つことができます。
株式会社A社は取得した特許Bを、米国審査ハイウェイ（PPH）を利用して、米国で特許出願を行います。米国審査ハイウェイ（PPH）とは、他国の審査結果又はPCTの調査成果に基づいて審査促進（早期審査）をするものです。（修正）特許の審査の期間の短縮を図ることができます。

Company A Co., Ltd. contacted us to ask for an IDS translation of patent B, which it had acquired in Japan, with the US application in mind.
2. Solution
We provided IDS translation of various patent publications of the prior art of patent B acquired by Company A Co., Ltd. IDS translation refers to translation related to the Information Disclosure Statement (IDS) in the US patent system, and when filing a patent application in the US, the applicant is obligated to disclose important information related to patentability to the US Patent and Trademark Office (USPTO). When submitting a document not in English as an IDS, a full or partial translation is required. IDS can be a key point when exercising rights in the US regarding patent B, and by translating IDS, it is possible to reduce legal risks such as patent invalidation trials, patent oppositions, and infringement lawsuits related to patent rights in the US, and maintain the validity of patent rights.
Company A Co., Ltd. will file a patent application in the US for patent B acquired by the company using the US Patent Prosecution Highway (PPH). The US Prosecution Highway (PPH) is a system that accelerates examination (accelerated examination) based on the examination results of other countries or the results of PCT searches.
