1．相談の内容
株式会社A社は、新製品Bを開発しましたが、他社の先行登録意匠の意匠権を侵害している可能性があり、その点に関してお問い合わせがありました。
2．解決策
新製品Bを販売するには、先行登録意匠の意匠権を考慮する必要があります。新製品Bの外観と先行登録意匠の外観とを比較して、新製品Bの外観と同一又は類似の先行登録意匠がある場合、新製品Bは、先行登録意匠の意匠権を侵害する可能性があります。そのため、j-platpatを用いて、新製品Bと同一又は類似の先行登録意匠があるかどうか、調査しなければなりません。
先行登録意匠を検索したところ、新製品Bの分野において、所定数の先行登録意匠が発見されました。新製品Bの外観と、先行登録意匠の外観とを検討したところ、新製品Bの外観と同一又は類似の先行登録意匠は見当たりませんでした。新製品Bは先行登録意匠の意匠権を侵害している可能性はありません。
