意匠出願の検討について

今回は、弊所の実績をスタッフ（I）からご紹介します。

1．相談の内容
A社は、機能性補助具について新しい商品の発売を準備しています。A社は、新しい商品について意匠登録出願をして、意匠権を取得することを検討し、ご相談に来られました。

2．解決策
今回の新しい商品は、静止状態から形状が変化して動く物品であったため、動的意匠での登録をお勧めしました。
動的意匠とは、形状や模様が機能に基づいて変化するデザインのことであり、意匠法6条4項で次のように示されています。
「意匠に係る物品の形状、模様若しくは色彩、建築物の形状、模様若しくは色彩又は画像がその物品、建築物又は画像の有する機能に基づいて変化する場合において、その変化の前後にわたるその物品の形状等、建築物の形状等又は画像について意匠登録を受けようとするときは、その旨及びその物品、建築物又は画像の当該機能の説明を願書に記載しなければならない。」
例えば、変形するおもちゃ、開閉する電化製品などが該当します。動的意匠の出願登録を行う場合は、動的意匠であること、及び物品の機能説明を願書に記載する必要があります。今回はそれらを記載し、変化の前後が分かるように図面を作成しました。

3．結論
　動的意匠は、変化する形状がたくさんあっても、形状ごとに意匠登録をする必要はなく、一つの願書で複数の形状をまとめて登録できます。一つの願書で全部登録できるのは企業にとっても費用を抑えて意匠登録を行えるという利点があります。

In this case, we described them and created drawings to show the before and after of the change.

Conclusion
　A dynamic design does not require a design registration for each shape, even if there are many shapes that change, but rather multiple shapes can be registered together in a single application. The advantage of being able to register all of them in a single application is that it allows companies to register their designs at a lower cost.
