化合物の先行技術調査について

今回は、弊所の実績をスタッフ（K）からご紹介します。

1．相談の内容
クライアントは、美容分野において、成分Aを含有する化合物について特許権を取得できないかを考えており、先行技術文献調査の依頼があった。

2．解決策
特許庁の「特許情報プラットフォームJ-PlatPat」を用いて、成分Aを含有する化合物に関する特許文献について調査した。その結果、他社で成分Aを有する化合物に関して特許権を取得しているものが見つかった。又、成分Aを有する化合物は、以前より使用されており、新規性がないことを説明した。過去に権利化されていた例として、成分Aと成分Bとの組み合わせの特許権が存在した。そこで、成分Aと、成分B以外の他の成分との組み合わせであれば、新規性を満たし得ることを提案した。進歩性として、実験例も検討して、顕著な効果を示すデータを検討するよう提案した。

3．結論
アイデアを権利化するために必要な構成要件を決めるには、アイデアと先行技術文献とを比較して、新規性や進歩性を判断することが大切である。当事務所では、先行技術文献調査によって、クライアントのアイデアの属する分野における既存技術や発明に至る動機の有無を調べ、権利化のための技術的助言をすることができます。お気軽にご相談ください。

1. Content of consultation
The client was considering whether it would be possible to obtain a patent for a compound containing component A in the beauty field, and requested a search of prior art documents.

2. solution
Patent documents regarding compounds containing component A were investigated using the Japan Patent Office's "Patent Information Platform J-PlatPat." As a result, we found that another company had obtained patent rights for a compound containing component A. It was also explained that the compound having component A has been used for some time and is not novel. As an example of a patent in the past, there was a patent for a combination of component A and component B. Therefore, we proposed that a combination of component A and other components other than component B can satisfy novelty. As an inventive step, it was proposed to also consider experimental examples and examine data showing significant effects.

3. conclusion
In order to determine the constitutional requirements necessary to obtain rights for an idea, it is important to compare the idea with prior art documents and determine novelty and inventive step.
