1．相談内容
クライアントは、自身の商標についてマドリッド協定議定書（以下「マドリッドプロトコル」）に基づく国際商標登録出願を行い、既に複数の外国において商標登録を取得しています。
今回、さらに別の外国においても商標登録を取得したいとの希望があり、その手続について当所に相談がありました。
2．解決策
マドリッドプロトコルにおける事後指定制度を利用することにより、既存の国際登録に基づいて、追加で外国を指定する手続の補助を行いました。
事後指定制度とは、マドリッドプロトコルによる国際商標登録出願後に、当初指定していなかった締約国を追加指定すること、または既存の指定国において、登録の範囲内で商品・役務を追加指定することが可能となる制度です。
本件では、事後指定に必要な書類である「MM4（E）– Designation Subsequent to the International Registration」の作成および提出に関する補助を行いました。

3．結論
マドリッドプロトコルに基づく国際商標登録出願を既に行っている場合であっても、事後指定制度を活用することにより、追加で別の国を指定して商標保護を拡張することが可能です。

1. Consultation Content
The client filed an international trademark registration application for their trademark under the Madrid Protocol (hereinafter referred to as the "Madrid Protocol") and has already obtained trademark registrations in several foreign countries.
Now, the client wishes to obtain trademark registrations in additional foreign countries and consulted our firm regarding the procedure.
2. Solution
We assisted the client in the procedure for designating additional foreign countries based on their existing international registration by utilizing the subsequent designation system under the Madrid Protocol.
The subsequent designation system allows a client to designate additional Contracting Parties not originally designated after filing an international trademark registration application under the Madrid Protocol, or to designate additional goods and services within the scope of the registration in existing designated countries.
In this case, we assisted with the preparation and submission of the "MM4(E) – Designation Subsequent to the International Registration," a document required for the subsequent designation.
