株式会社A社様より、出願中の意匠Cに対して特許庁から拒絶理由通知書が送付されたとのことで、その内容および今後の対応方針についてご相談をいただきました。

2. 解決策
株式会社A社様は、これまでに意匠Bを出願し、意匠登録を受けられています。今回問題となっている意匠Cについて、意匠Bとの関係を検討した結果、両意匠は意匠法第10条第2項および第8項に規定される「自己の意匠」に該当し、かつ創作思想の範囲を共有するものであることが確認できました。

意匠Bと意匠Cの相違点は、いずれも基礎意匠（引用意匠）の創作思想を損なわない範囲での形状変化にとどまっており、意匠法第10条第2項で定める「基礎意匠と同一又は類似の範囲内での創作」に該当します。

そのため、引用意匠である意匠Bは、意匠法第10条第2項および第8項に基づき「自己の意匠」として取り扱われ、新規性・創作非容易性の判断における除外事由となります。これらの点を踏まえ、拒絶理由通知に対する応答書面（意見書および補正書案）を作成し、A社様へご提案いたしました。

Response to a Notice of Reasons for Rejection of a Design Application

1. Consultation Details
Company A informed us that the Japan Patent Office had sent them a Notice of Reasons for Rejection regarding their pending application for Design C. They consulted us regarding the content of the Notice and their future course of action.

2. Solution
Company A had previously filed and received a design registration for Design B. After examining the relationship between Design C and Design B, we confirmed that both designs qualify as "self-designs" as defined in Article 10, Paragraphs 2 and 8 of the Design Act and share the same creative concept.

The differences between Design B and Design C are limited to shape changes that do not impair the creative concept of the underlying design (cited design), and therefore qualify as "creations within the scope of identity or similarity to the underlying design" as defined in Article 10, Paragraph 2 of the Design Act.

Therefore, the cited design, Design B, is treated as a "self-design" under Article 10, Paragraphs 2 and 8 of the Design Act, and is therefore excluded from the determination of novelty and duplicability. Taking these points into consideration, we prepared a response (argument and proposed amendment) to the Office Action and proposed it to Company A.
