1．相談の内容
A社より、自社で発案したオリジナルキャラクターデザインについて、将来的なグッズ化を見据え、どのような形で権利保護を進めるべきかとの相談を受けました。
2．解決策
まず、キャラクターデザインそのものが既に公開されていないか、また類似の既存キャラクターがないかという観点から、先行データベースを調査し、登録可能性を検討しました。
商標出願については、キャラクター図形を商標として用いる可能性があるため、指定商品・役務を将来の展開を見据えて、それらを広く検討しました。
著作権については創作した時点で発生するものの、紛争時に証明力を確保するため、創作資料の保存や制作過程の記録が必要になる場合もあることもあります。又、実名を登録すれば、その著作者であると推定されますし、第一発行年月日等を登録を行うことにより、その日に発行されたものと推定されるという登録の効果もあります。
