1. ご相談内容
株式会社A社様より、「名称B」「名称C」について
商標登録出願が可能かどうかの事前調査のご依頼をいただきました。
2. 解決策
私たちは、特許庁公式データベース「J-PlatPat」を活用し、
「名称B」「名称C」に関する商標の出願状況を徹底的にリサーチしました。
初回の検索では該当商標はヒットしませんでしたが、
さらに踏み込んで指定区分X類において「称呼検索」を実施したところ、
下記のような結果が得られました。
・名称Bについて
区分X類で、カタカナ末尾に「ン」が付いた名称BNが確認されました。
カタカナ「ン」は、商標審査基準上「弱音（発音の響きが弱く、聴覚上明瞭でない音）」とされます。
そのため、「名称B」と「名称BN」は聴覚上類似と判断され、
名称BNの商標が現存している（抹消されていない）ため、
名称Bでの商標登録は難しいという結論に至りました。
・名称Cについて
区分X類で、「カタカナ1文字『h』を半濁音『p』に置き換えた」名称CPが検索されました。
審査基準によると、
「清音（ハ行音）・半濁音（パ行音）・濁音（バ行音）の違いのみでは、全体の印象が近似して聴覚されることが多い。」
とされています。
このため、「名称C」と「名称CP」は類似商標と判断され、
名称CPの商標が有効に存続していることから、
名称Cでの登録も困難という結論になりました。

3. 結論
商標登録の可否は、発音やわずかな表記の違いでも結果が変わる繊細な領域です。
今回のように、「ほんの1文字の違い」でも登録の可否を左右するケースは多くあります。

Investigation of Trademarks with Similar Names
1. Inquiry Details
We received a request from Company A to conduct a preliminary investigation into the possibility of trademark registration for "Name B" and "Name C."
2. Solution
We thoroughly researched the trademark application status of "Name B" and "Name C" using the Japan Patent Office's official database, "J-PlatPat."
While the initial search did not yield any matching trademarks,
a more in-depth "phonetic search" within designated class X revealed the following results:
・Regarding Name B:
In class X, a name "BN" ending with the katakana character "ン" was found.
The katakana character "ン" is considered a "weak sound (a sound with a weak resonance and not clearly audible)" under the trademark examination standards.
Therefore, "Name B" and "Name BN" were judged to be phonetically similar, and
since the trademark for Name BN is currently existing (not cancelled),
we concluded that trademark registration for Name B would be difficult.
・Regarding Name C:
In class X, a name "CP" was found where "the single katakana character 'h' was replaced with the semi-voiced consonant 'p'."
According to the examination standards:
"Differences only in unvoiced consonants (ha-line sounds), semi-voiced consonants (pa-line sounds), and voiced consonants (ba-line sounds) often result in similar overall impressions and auditory perception."
Therefore, "Name C" and "Name CP" were judged to be similar trademarks, and
since the trademark for Name CP is still valid,
we concluded that registration for Name C would also be difficult.

3. Conclusion
The possibility of trademark registration is a delicate area where even slight differences in pronunciation or spelling can change the outcome.
As in this case, there are many instances where "a difference of just one character" can determine the possibility of registration. We utilize the official database of the Japan Patent Office to quickly conduct reliable trademark searches that provide peace of mind for your business.
