1．相談の内容
A社から、自社の社名を商標として保護したいとの相談を受け、出願したところ、特許庁から他社の先願・先登録商標と類似するとの理由で拒絶理由通知が届いたため、どう対応すべきかご相談がありました。
2．解決策
今回の場合、審査官が重視する観点に沿って、外観・称呼・観念ごとに具体的比較を示し、論理的に反論する意見書の作成を検討しました。加えて、WEB上の使用実績も整理して証拠として、実際の取引状況から出所混同のおそれがないことを示す根拠を示しました。さらに、先願商標の称呼・観念が一般的・記述的である点を指摘し、審査官が短時間で判断できるよう、分かりやすく構成しました。

In this case, we considered preparing a logical argument that provided specific comparisons of appearance, pronunciation, and concept, based on the examiner's priorities. Additionally, we compiled online usage data as evidence, providing evidence that actual transactions demonstrate there is no risk of confusion. Furthermore, we pointed out that the pronunciation and concept of the prior trademark were generic and descriptive, providing an easy-to-understand argument that allowed the examiner to quickly make a decision.
3. Conclusion
