1. Consultation Details
Company A consulted us regarding trademark registration for their company's services. With an eye toward establishing their brand and expanding their services in the future, they wanted to protect the name of their service while avoiding confusion with other companies.
2. Solution
After investigation, we discovered that the "▲▲▲" portion of the desired trademark "●●▲▲▲" overlaps with a prior trademark. Since the similarity of this "▲▲▲" portion is a key factor in determining whether or not a trademark can be registered, we needed to carefully consider how the examiner would assess the similarity. To increase the likelihood of registration, it is effective to clearly adjust the scope of the designated services and to use display techniques that avoid similarity (e.g., logos, combined typefaces, and colors). Adding a ●● does not guarantee safe registration, so measures to increase the likelihood of registration are necessary. In this case, we carefully considered the registration classification and presented them to the client.
