商標を出願した際の登録可能性

1. ご相談内容

株式会社A様より、新たなサービス展開にあたり、
ネーミング候補「名称B」とその呼び名「称呼C」について、
商標登録の可否を事前に確認したいとのご相談をいただきました。

新サービスのブランド構築において、商標のクリアランス調査は極めて重要なステップです。
万が一、既存の商標権と衝突した場合には、使用差し止めや損害賠償といったリスクも生じます。

2. 調査のポイントと結果

当所では、特許庁が提供する公式データベース「J-PlatPat」を活用し、
以下の2点に重点を置いて調査を実施しました：

「名称B」について第X類とした場合

商標としての識別力（※）が十分にあるか

同一または類似の名称が、同一または類似区分で既に出願・登録されていないか

※識別力とは、他の商品・サービスと区別する力のこと。商標登録にはこの「識別力」が必要です。

結果：
「名称B」には識別力があり、第X類（化粧品・洗剤などの区分）において同様の登録商標も確認されなかったため、商標出願の可能性は高いと判断されました。

「称呼C」について第X類とした場合

呼び名としての音や読み方が、既に他の登録商標と類似していないか

結果：
称呼Cに関しては、第X類（化粧品・洗剤などの区分）において、
先行登録商標が確認されたため、現状では出願は難しいという結論となりました。

Possibility of trademark registration upon application

1. Consultation Content

Company A, Inc., contacted us to confirm the possibility of trademark registration for the proposed name "Name B" and its pronunciation "Name C" in advance of the launch of a new service.

A trademark clearance search is an extremely important step in building the brand of a new service.
In the unlikely event of a conflict with an existing trademark, there is a risk of injunctions or damages.

2. Search Key Points and Results

Our firm conducted a search using the official database "J-PlatPat" provided by the Japan Patent Office, focusing on the following two points:

If "Name B" were classified as Class X

Is the trademark sufficiently distinctive? (※)

Has an identical or similar name already been applied for or registered in the same or similar category?

※Distinctiveness refers to the ability to distinguish a product or service from other products or services. This "distinctiveness" is required for trademark registration.

Result:
"Name B" is distinctive, and no similar registered trademarks were found in Class X (cosmetics, detergents, etc.), so it was determined that a trademark application was likely.

If "Pronunciation C" were classified as Class X:

Is the sound or pronunciation of the name similar to other registered trademarks?

Result:
Regarding Phonetic Name C, a prior registered trademark was found in Class X (cosmetics, detergents, etc.),
so it was concluded that an application would be difficult under the current circumstances.
