事例：先行技術調査（流体制御装置）

1．相談の内容
　クライアントは、新規に開発した流体制御に関する3つの装置について、知的財産権による保護を受けたいとの意向を持ち、弊所に相談されました。

2．解決策
　特許庁の特許情報プラットフォーム J-PlatPat を用いて、先行特許文献調査を実施しました。
その結果：
装置A：構造や有利な効果が先行文献には見られず、進歩性が認められる可能性があるため、特許出願を検討可能と判断。
装置B・装置C：構造が従来技術と類似しており、有利な効果も見出しにくいため、進歩性が乏しいと考えられる。したがって、実用新案登録や意匠登録など、特許以外の知的財産権による保護を検討する方向性が望ましいと判断。

3．結論
　知的財産権による保護を受けるためには、先行技術調査を行い、自社のアイデアを先行技術と対比し、新規性・進歩性を備えているかを検討することが重要です。今回のケースでは、装置ごとに適切な保護手段を選択する必要があるとの結論に至りました。

1. Consultation Content
The client contacted us with the intention of obtaining intellectual property rights protection for three newly developed fluid control devices.

2. Solution
We conducted a prior patent document search using the Japan Patent Office's patent information platform, J-PlatPat.
Results:
Device A: The structure and beneficial effects were not found in prior documents, suggesting a potential inventive step, and therefore we determined that a patent application was feasible.
Device B and Device C: The structure is similar to prior art, and beneficial effects are difficult to identify, suggesting a lack of inventive step. Therefore, we determined that it would be better to consider protection through intellectual property rights other than patents, such as utility model registrations or design registrations.

3. Conclusion
To obtain intellectual property rights protection, it is important to conduct a prior art search, compare your company's idea with prior art, and determine whether it possesses novelty and inventive step. In this case, we concluded that it was necessary to select appropriate protection measures for each device.
