1．相談の内容
クライアントは、新規に創作した機械について、意匠登録出願を希望し、弊所にご相談いただきました。
2．解決策
意匠登録出願に必要な書類の作成を支援しました。具体的には、
・意匠登録を受けようとする物品の六面図や、実際の機械の写真を含む図面を作成
・物品の説明等を含む願書の作成を支援
・代替可能な部品については意匠登録対象から外し、図面では破線を用いて記載
・使用状態を示す参考図を作成し、物品の動作や使用方法を補足
これにより、審査官が本意匠の特徴や機能を理解しやすい出願書類を整えることができました。
3．結論
意匠登録出願においては、まず六面図を正確に記載することが不可欠です。さらに、機械的に動作する物品の場合には、使用状態を示す参考図や物品説明を適切に追加することで、意匠の理解を補助し、登録可能性を高めることができます。

1. Consultation Details
The client contacted us with a request for a design registration for a newly created machine.
2. Solution
We assisted in preparing the necessary documents for a design registration application. Specifically,
- We created drawings including a six-view drawing of the item for which the design is to be registered and photographs of the actual machine.
- Assisted in the preparation of an application including a description of the item.
- We excluded interchangeable parts from the scope of the design registration and indicated them using dashed lines in the drawings.
- We created a reference drawing showing the item in use and supplemented the item's operation and usage.
This enabled us to prepare application documents that would help the examiner understand the design's features and function.
3. Conclusion
When filing a design registration application, it is essential to first accurately include a six-view drawing. Furthermore, in the case of mechanically operated items, adding appropriate reference drawings showing the item in use and descriptions of the item can aid in understanding the design and increase the likelihood of registration.
