1．相談の内容

Application support based on competitive patent analysis

1. Consultation Details
Company A consulted us about considering filing a patent or utility model application for a newly developed household product. In particular, they wanted to understand why their technology was granted a patent and how they overcame rejections, taking into account the filing status of competitors' applications.

2. Solution
To understand the scope of competitors' rights, determine whether there was a risk of infringement in relation to our own products, and identify technological points that could differentiate us, we analyzed the reasons for rejection and the prosecution process for the competitor's application, if any.
Specifically, by researching competitors' patent publications and prosecution history information and summarizing the examiner's focus and the reasons for rejection, we were able to compare their technology with our own and clarify their strengths and uniqueness. Furthermore, we were able to consider in advance countermeasures for when we face similar challenges.
