まずは、その技術が実用新案として保護可能かどうかを判断するための材料を得る目的で、先行技術調査を実施しました。その結果、当該技術の一部については、すでに公知の文献が存在していることが明らかとなりました。そこで、単なる着想や用途の新しさにとどまらず、具体的にどのような形状や構造上の特徴があるのかを整理し直す必要があると判断しました。
どの部分に創意工夫が加えられており、どの点で既存技術との差別化が図られているのか、そしてそれがどのような機能的意義を持つのかを、明確に特定することが重要です。特に実用新案制度においては、構造の具体性が保護の対象となるため、単なるアイデアではなく、明確な「形状」や「構造」の工夫として表現されていなければ、権利として認められません。

2. Solution
First, we conducted a prior art search to obtain evidence to determine whether the technology in question could be protected as a utility model. As a result, we discovered that publicly available literature already existed for some of the technology. Therefore, we decided that it was necessary to reassess the specific shape and structural features of the technology, rather than simply focusing on the novelty of the concept or application.
It is important to clearly identify which aspects of the technology incorporate originality and ingenuity, how it differentiates from existing technology, and what functional significance it possesses. In particular, under the utility model system, structural specificity is the subject of protection. Therefore, patents will not be recognized unless the specificity is expressed as a clear "shape" or "structure," rather than simply an idea.
