1．相談の内容
A様からアパレル製品に関する独自のデザイン・構造について、特許もしくは実用新案、意匠として保護が可能かどうかを確認したいというご相談をいただきました。対象となる製品は特徴的な形態構造であり、知的財産として保護可能かどうかを出願前に見極めたいというご要望でした。

2．解決策
まず、対象製品の構造的特徴、意匠的要素、機能的効果について整理したうえで、公開特許公報や意匠公報を中心に、先行技術調査を実施しました。調査では、類似の縫製技術や機能衣料に関する出願例、また衣服の部分構造に関する技術の登録動向を把握し、差別化の程度や出願可能性を分析しました。その結果、既存公報との重複が見受けられため、現時点で保護が見込める技術的・形状的要素を特定し、それらについて実施可能性の観点からも検討を行いました。今後は、既存技術との差異を明確にしつつ、実際に実施できる構成に絞って出願準備を進めることとなります。

1. Content of the consultation
Mr. A consulted us to confirm whether the unique design and structure of apparel products could be protected as a patent, utility model, or design. The target product has a distinctive shape and structure, and he wanted to determine whether it could be protected as intellectual property before filing.

2. Solution
First, we organized the structural features, design elements, and functional effects of the target product, and then conducted a prior art search, mainly focusing on published patent publications and design publications. In the search, we identified examples of applications for similar sewing techniques and functional clothing, as well as registration trends for technologies related to the partial structure of clothing, and analyzed the degree of differentiation and possibility of application. As a result, we found overlaps with existing publications, so we identified technical and shape elements that can be protected at this time and considered them from the perspective of feasibility. In the future, we will proceed with preparations for the application by clarifying the differences from existing technologies and focusing on configurations that can actually be implemented.

3. Conclusion
Based on the prior art search, our firm proposes applications that focus on components that can actually be protected and implemented. Obtaining intellectual property rights not only prevents imitation, but also provides a great advantage in product differentiation and market expansion.
