1．相談の内容
A様から独自のコンセプトを持った店名を商標として保護したいとのご相談がありました。
2．解決策
商標が提供するサービスの質や特徴、提供方法などを一般的な言葉で表している場合には、商標登録を認めないとされています。これは、そのような言葉には、特定のお店や人を識別する機能（識別力）がないと判断されるためです。
また、単にサービスの内容を説明するにとどまる言葉や、需要者が「どこの店舗のものか」や「誰が提供しているサービスか」を識別できないような記述的な表現についても、原則として、登録の対象とはなりません。
このような場合の解決策としては、独自に創作した語句（造語）やブランド名、ロゴマークなどと組み合わせて出願する方法が考えられます。又、長期間にわたって継続的に使用し、その言葉がA様のサービスを示すものとして一般に認識されるに至った場合には、改めて登録の可能性を検討することもできます。

2. Solution
If a trademark expresses the quality, characteristics, or method of providing the service provided in general words, it is not allowed to register as a trademark. This is because such words are judged to have no function (distinctiveness) to identify a specific store or person.
In addition, words that merely describe the content of the service or descriptive expressions that do not allow consumers to identify "which store it is" or "who is providing the service" are not eligible for registration in principle.
As a solution in such cases, a method of applying for a trademark in combination with a uniquely created phrase (neologism), brand name, logo mark, etc. can be considered. In addition, if the word is used continuously for a long period of time and becomes generally recognized as indicating Mr. A's service, the possibility of registration can be reconsidered.
