1．相談の内容
A様から、すでに取得済みの商標権についてご相談をいただきました。対象となる商標は現在、存続期間の満了日を過ぎ、更新可能な期間中にありますが、今後は内容を変更した新たな商標を取得したいとのご希望でした。

2．解決策
商標は、存続期間の満了日を過ぎても6か月以内であれば更新が可能ですが、その場合は更新料が通常の2倍となります。満了日を過ぎてからの更新費用と新規申請の費用を比較すると、今回のケースでは、大幅な差が生じるため、新たに商標を申請したほうが、コストが抑えられるということが分かりました。
また、出願人が同一であれば、旧商標と新商標が併存することも可能であり、旧商標の継続を希望されない場合は、新商標だけを権利化することができ、手続きの簡略化とコスト削減の両面でメリットがあります。

2. Solution
A trademark can be renewed within six months of the expiration date, but in that case the renewal fee will be twice as much as usual. In this case, when comparing the cost of renewal after the expiration date with the cost of a new application, there is a significant difference, so it was found that applying for a new trademark would be more cost-effective.
In addition, if the applicant is the same, the old and new trademarks can coexist, and if you do not wish to continue using the old trademark, you can obtain rights for only the new trademark, which has the benefits of both simplified procedures and reduced costs.
