1．相談の内容
クライアントは、生活雑貨の企画・製造・販売を手がける企業であり、商品の差別化とブランドイメージの向上を目的として、新しく開発した商品に「実用新案登録済」の表示を行って販売活動を行いたいと考え、当事務所にご相談されました。
2．解決策
クライアントより提供された商品仕様書や設計図に基づき、明細書および図面を作成しました。
実用新案権は、無審査で登録されますが、他者に対して差止請求や損害賠償請求等の権利行使を行うには、「実用新案技術評価書」の請求が必要となり、確実に権利行使を行うためには、「評価6」を受けることが望まれます。
実用新案登録後、商品を販売し、その売れ行きが好調であれば、実用新案技術評価を請求し「評価6」を受けることで、自社の商品を守るという戦略も取れます。そのためには、アイデアが新規性や進歩性等を有することが要件となります。又、実用新案登録出願の日から3年以内であれば、特許出願に変更することもできるので、特許権取得を目指すことも出来ます。
3．まとめ
仮に権利行使を予定していない場合でも、実用新案登録を取得することで、そのアイデアが「公的に認められた技術」であることを対外的に示すことができます。また、知的財産活動に積極的な企業としてのイメージを消費者に訴求でき、宣伝や販促活動においても有効です。
