1．相談の内容
クライアントは、新たに開発した機械装置に関して特許出願を行いましたが、特許庁より進歩性の欠如を理由とする拒絶理由通知を受け、当事務所にご相談いただきました。
2．解決策
拒絶理由通知では、2件の先行文献が引用されており、本願発明の各種パラメータの数値限定が、当業者が通常の設計判断で設定可能な範囲に留まるとして、進歩性が否定されていました。
そこで、私たちは本願発明の数値限定がもたらす技術的効果を、引用文献のものと比較検討し、本願発明における一部のパラメータの数値限定が、従来技術とは異なる有利な効果を発揮することを確認しました。
これに基づき、当該数値限定を明確に反映させるよう特許請求の範囲を補正するとともに、本願発明が当業者の通常の設計判断を超える技術的意義を有することを、意見書にて主張しました。

3．結論

1. Content of the consultation
The client filed a patent application for a newly developed mechanical device, but received a notice of rejection from the Japan Patent Office due to a lack of inventive step, and consulted our office.
2. Solution
The rejection cited two prior art documents, and denied the inventive step, stating that the numerical limitations of various parameters in the present invention were within the range that a person skilled in the art could set using normal design judgment.
We therefore compared the technical effect of the numerical limitations of the present invention with those of the cited documents, and confirmed that the numerical limitations of some parameters in the present invention have advantageous effects different from those of the prior art.
Based on this, we amended the claims to clearly reflect the numerical limitations, and argued in a written opinion that the present invention has technical significance that goes beyond the normal design judgment of a person skilled in the art.

3. Conclusion
