1．ご相談内容
株式会社A社様より、「すでに事業化が進んでいる特許Bについて、できるだけ早く審査を受けたい」とのご相談をいただきました。
市場投入が目前に迫る中、知的財産の保護体制を万全にするために、特許庁への早期審査申請をご希望でした。

2．対応と解決へのアプローチ
早期審査を活用するためには、「出願審査請求」がすでに行われていることが前提条件となります。未請求の場合には、出願審査請求と早期審査請求を同時に提出する必要があります。弊所ではこの点を確認のうえ、次のステップへと進みました。

さらに、早期審査の申請を確実に通すために、先行技術文献調査を徹底的に実施。今回の出願明細書に記載されている3件の文献に加え、他分野における関連技術についても独自に調査を行いました。
調査は令和7年X月Y日に実施し、「C＊D」というキーワードを用いて、国内外の特許文献・非特許文献にわたって調査を実施。その結果、新たに数件の国内文献が抽出されましたが、特許Bの開示内容と競合・重複するものは見つかりませんでした。

この結果をもとに、早期審査の要件を満たしていることを確認し、早期審査請求書を正式に作成・提出。

Patent research for accelerated examination

1. Consultation details
Company A consulted us on the matter, saying, "We would like to have Patent B, which has already been commercialized, examined as soon as possible."
With the market launch imminent, they wanted to apply for accelerated examination to the Japan Patent Office in order to fully protect their intellectual property.

2. Approach to response and resolution
In order to utilize accelerated examination, it is a prerequisite that a "request for application examination" has already been made. If a request has not been made, a request for application examination and a request for accelerated examination must be submitted at the same time. After confirming this point, our office proceeded to the next step.

Furthermore, in order to ensure that the application for accelerated examination is approved, a thorough prior art literature search was conducted. In addition to the three documents listed in the application specification, we also conducted our own research on related technologies in other fields.
The search was conducted on X/Y, 2025, and a search was conducted across domestic and international patent and non-patent literature using the keyword "C*D". As a result, several new domestic documents were extracted, but none were found that conflicted or overlapped with the disclosure of Patent B.

Based on this result, confirm that the requirements for accelerated examination are met, and formally prepare and submit a request for accelerated examination.
