1．ご相談内容
株式会社A社様より、同社が独自に開発した革新的な技術「技術B」を搭載した新商品「商品C」について、特許や実用新案としての保護が可能かどうか、また、特許出願に必要な書類作成のサポートが受けられるかどうかについてご相談をいただきました。
「自社の技術が本当に特許になるのか？」という疑問に、弊所が全力でお応えしました。
2．対応内容と解決へのステップ
まず初めに、商品Cのデザインが既に意匠登録されていないかを、J-PlatPatを活用して徹底的に調査。結果として、同一形状の意匠登録は確認されず、商品Cのオリジナリティが明確になりました。
次に、技術Bに関して、国内外の特許および実用新案に関する先行技術文献を広範囲にリサーチ。その結果、既存技術と競合・抵触する情報は見当たらず、技術Bには新規性があることが判明しました。

1. Consultation details
Company A consulted us about whether it is possible to protect its new product "Product C," which is equipped with the innovative technology "Technology B" that the company developed independently, as a patent or utility model, and whether they can provide support in preparing the documents necessary for the patent application.

2. Response details and steps to resolution
First, we thoroughly investigated using J-PlatPat whether the design of Product C had already been registered as a design. As a result, we found no design registrations for the same shape, and the originality of Product C became clear.
Next, we extensively researched prior art documents related to domestic and international patents and utility models for Technology B. As a result, we found no information that conflicted or conflicted with existing technologies, and found that Technology B was novel.
