1．相談の内容
クライアントは、新規に開発した機械部品の製造システムについて、特許出願を行いましたが、進歩性違反を理由に、拒絶理由通知を受け、弊所に相談されました。
2．解決策
本願発明と、拒絶理由通知に記載の引用文献に記載の発明とを比較し、引用文献に記載の無い発明特定事項を、出願当初明細最初から追加することで、特許請求の範囲の補正を検討しました。又、意見書において、当該補正が新規事項の追加や発明の特別な技術的特徴を変更する補正ではないことを示し、引用文献に記載の発明とは発明の構成が異なり、又、引用文献に記載の発明には無い効果を得ることができることを検討しました。
3．結論
特許出願において拒絶理由通知を受けた場合には、拒絶理由通知中の引用文献と本願発明とを比較し、新規性や進歩性を有するように、出願当初明細書に記載の内容に基づいて特許請求の範囲を補正し、その補正によって新規性や進歩性を有することを説明する必要があります。弊所では、特許出願に関するご相談を承っております。お気軽にお問い合わせください。

1. Content of the consultation
The client filed a patent application for a newly developed machine part manufacturing system, but received a notice of reasons for refusal due to a violation of inventive step, and consulted our firm.
2. Solution
We compared the present invention with the inventions described in the references listed in the notice of reasons for refusal, and amended the scope of the patent claims by adding the invention-specific matters not described in the references from the beginning of the original application description. In addition, in the written opinion, we indicated that the amendment was not an amendment that added new matters or changed the special technical features of the invention, and explained that the configuration of the invention is different from that of the inventions described in the references, and that effects not found in the inventions described in the references can be obtained.
3. Conclusion
When a notice of reasons for refusal is received for a patent application, it is necessary to compare the references in the notice of reasons for refusal with the present invention, amend the scope of the patent claims based on the contents of the original application description so that the invention has novelty and inventive step, and explain that the amendment has novelty and inventive step.
