1．相談の内容
A社は、新しい器具の開発に成功し、実用新案の申請を希望されました。実用新案を申請するためには、複数の書類が必要となりますが、特に、明細書の作成において、従来技術の整理と説明が必要になり、どのように記載すべきか弊所に相談がありました。

従来技術の記載が不十分な場合、審査段階で拒絶が生じるリスクや権利範囲が曖昧になるおそれがあります。そのため、弊所ではまずJ-Platpatなどのデータベースを活用し、関連する先行技術や公報を徹底的に調査しました。
そのうえで、従来技術の特徴や課題を分かりやすく整理し、A社の新しい商品がどのように従来技術の課題を解決しているかを図面等も活用しながら、具体的に明細書に反映させ、技術的な差異を明確にしました。
