1．相談の内容
クライアントは、顧客から写真等のデータの提供を受け、グッズを製作するサービスを行っています。しかしながら、一部の顧客が、他人の著作権・肖像権・商標権等を侵害するおそれのあるデータを使用したグッズ製作を注文する例があります。このような他人の権利を侵害するおそれのある注文への対応について、弊所に相談されました。
2．解決策
同様のサービスを行う他社の事例について調べました。その結果、注文用のウェブサイトにおいて、著作権・肖像権・商標権等の説明をし、これらの権利を侵害するおそれのある注文を受けることができない旨、万が一、権利侵害が生じたとしてもその責任を負わない旨の記載をしていました。
これにより、グッズ製作によって他人の権利を侵害する事態や、その責任を企業が負うことになる事態を避けることができると考えられます。
3．結論
一般消費者の中には、他人の権利を侵害するおそれのあることを知らずに、グッズ製作等を依頼する人もいます。そのため、これらの権利に関して一般消費者にも分かりやすい説明を行い、これらの権利を侵害する注文を受けることはできない事、又、権利侵害が生じたとしてもその責任を企業側は負わないことをきちんと説明する必要があります。弊所では、知的財産権に関する相談を承っております。お気軽にお問い合わせください。

1. Content of the consultation
The client provides a service to create goods using data such as photos provided by customers. However, there are cases where some customers order the creation of goods using data that may infringe on the copyright, portrait rights, trademark rights, etc. of others. The client consulted us about how to deal with such orders that may infringe on the rights of others.
2. Solution
We investigated the cases of other companies that provide similar services. As a result, on the ordering website, they explained copyright, portrait rights, trademark rights, etc., and stated that they could not accept orders that may infringe on these rights, and that they would not be held responsible in the unlikely event that an infringement of rights occurred.
This is thought to prevent situations in which the creation of goods infringes the rights of others, or in which the company is held responsible for such infringement.
3. Conclusion
Some general consumers request the creation of goods without knowing that there is a risk of infringing on the rights of others. Therefore, it is necessary to provide an explanation of these rights that is easy for the average consumer to understand, and to clearly explain that they cannot accept orders that infringe on these rights, and that the company will not bear responsibility even if any infringement of rights occurs.
