1．相談の内容
クライアントは、自身の登録商標を、他人がクライアントの許可なく使用し、顧客を集めていることを発見し、商標権侵害であるとして、その対応を弊所に相談されました。
2．解決策
まず、この他人がクライアントの登録商標を指定役務において使用していることを示す証拠を集めました。その中で、この他人がクライアントの商標権を回避するために、登録商標を一部変更した商標を使用していることが分かりました。
そのため、登録商標や登録商標を一部変更した商標の使用の差止請求を行うとともに、登録商標を一部変更した商標の使用を確実に阻止するために、新規に登録商標出願を行うことを提案しました。

3．結論
他人が、自己の登録商標や類似する商標を許可なく使用している場合には、その証拠を集め、差止請求することが必要です。又、登録商標に類似する商標の使用を阻止するために、新規に商標登録することも有効な手立てです。

1. Content of the consultation
The client discovered that someone else was using his registered trademark without the client's permission to attract customers, and consulted our firm on how to deal with the situation, claiming that this was a trademark infringement.
2. Solution
First, we gathered evidence showing that this other person was using the client's registered trademark in the designated services. Among them, we found that this other person was using a trademark that was partially modified to circumvent the client's trademark rights.
We therefore filed an injunction against the use of the registered trademark and the trademark that was partially modified, and proposed to file a new registered trademark application to ensure that the trademark that was partially modified was not used.

3. Conclusion
If someone else is using your registered trademark or a similar trademark without permission, you need to gather evidence and request an injunction. It is also an effective measure to register a new trademark to prevent the use of a trademark similar to your registered trademark.
