1．相談の内容
インテリアクラフト商品を開発したお客様が、知的財産権の申請を検討し、弊所にご相談がありました。
2．解決策
まず、商品の詳細な情報をお伺いし、先行技術調査を行いました。具体的には、類似の既存商品や特許、実用新案、意匠について、広範囲にわたる調査を行いました。調査の結果、用途が類似する特許と実用新案が存在することが判明しましたが、形状が異なりました。
さらに、インターネット上で類似商品が販売されていることも確認されましたが、形状に関しては相違点が見られました。
この調査結果を踏まえ、当該商品については、特許か実用新案での出願が適切ではないかという結論に至りました。今後は、権利化の可能性を慎重に見極めつつ、最適な知的財産戦略を策定していく予定です。

Optimal Intellectual Property Strategy
1. Content of the consultation
A client who developed an interior craft product consulted us on the possibility of applying for intellectual property rights.
2. Solution
First, we asked for detailed information about the product and conducted a prior art search. Specifically, we conducted a wide-ranging search on similar existing products, patents, utility models, and designs. As a result of the search, we found that there were patents and utility models with similar uses, but different shapes.
In addition, we confirmed that similar products were being sold on the Internet, but there were differences in the shapes.
Based on the results of this search, we came to the conclusion that it would be appropriate to apply for a patent or utility model for the product in question. In the future, we plan to carefully assess the possibility of obtaining rights and formulate an optimal intellectual property strategy.
