「●●＋士業名」の商標登録に関して

1．相談の内容
A社が「●●●●●士」という言葉を含めた商品を検討し、「●●＋士業名」の商標登録に関するご相談が弊所にありました。

2．解決策
まず、先行出願商標の調査を行いました。この調査は、類似の商標が存在するかどうかを確認することを目的としています。調査の結果、類似する商標が存在することが判明しました。また、拒絶され、登録できなかった商標も見受けられました。拒絶理由を精査したところ、「公序良俗に反する」という判断が下されたケースがありました。具体的には、「「●●●●●士」という表現が、公的な資格や職業を不当に連想させたり、誤認する恐れがある場合、公序良俗に反するとして、登録が認められなかったということが分かりました。（商標法第4条1項第7号）

Regarding trademark registration of "●● + professional name"

1. Content of the consultation
Company A was considering a product that included the word "●●●●●" and consulted us about the trademark registration of "●● + name of professional".

2. Solution
First, we conducted a search of prior trademark applications. The purpose of this search is to check whether similar trademarks exist. As a result of the search, we found that similar trademarks exist. We also found that some trademarks were rejected and could not be registered. After examining the reasons for refusal, we found that in some cases the decision was made that the expression was "contrary to public order and good morals." Specifically, we found that "if the expression "●●●●●" is likely to be misleading or inappropriately associated with a public qualification or occupation, it is deemed to be contrary to public order and good morals and therefore registration was not allowed.
