1．相談の内容
株式会社A社は、自社の登録商標Oに関して、海外へ商標登録出願ができるかどうか、又、費用がいくらぐらいかかるか、問い合わせがありました。
2．解決策
弊所は、株式会社A社に、海外へ商標登録出願する場合、パリ条約の優先権主張を用いて行うか、国際登録出願（マドプロ出願）を用いて行うことが出来ることを助言しました。
ここで、マドプロ出願を行う場合は、国内の登録商標O（又は、出願商標）をもとに行う必要があります。
株式会社A社が出願しようとしている国は、Q国、R国、S国、T国などです。海外にマドプロ出願で行う際に、WIPO Madrid System Fee Calculatorのページから、料金がいくらかかるか計算することができます。
なお、マドプロ出願を行う際に、複数の国で商標登録出願をする場合は、複数の国の現地代理人の費用が削除することが出来るため、費用的に大きなメリットがあります。具体的には、3国以上に出願しようとしている場合は、マドプロ出願が適切です。
一方、出願しようとしている国が1国、2国である場合は、単独でそれぞれの国へ現地代理人を通じて出願した方が、費用的に安く済みます。
ここで、マドプロ出願では、出願商標の要件として、国内で基礎となる登録商標または出願商標と同一である必要がありますので、注意が必要です。具体的には、弊所にお問い合わせ下さい。

Costs of filing trademark registration overseas
1. Content of consultation
Company A Co., Ltd. asked whether it is possible to file trademark registration overseas for its registered trademark O and how much it would cost.
2. Solution
We advised Company A Co., Ltd. that when filing trademark registration overseas, it can be done using the Paris Convention priority claim or an international registration application (Madrid Protocol application).
If you file a Madrid Protocol application, you must do so based on the domestic registered trademark O (or the applied trademark).
The countries in which Company A Co., Ltd. is planning to file are Country Q, Country R, Country S, Country T, etc. When filing a Madrid Protocol application overseas, you can calculate the fees from the WIPO Madrid System Fee Calculator page.
When filing a Madrid Protocol application in multiple countries, there is a significant cost advantage in that you can eliminate the fees of local agents in multiple countries. Specifically, if you are planning to file in three or more countries, a Madrid Protocol application is appropriate. On the other hand, if you are planning to apply in only one or two countries, it will be cheaper to apply in each country individually through a local agent.
However, please note that in a Madrid Protocol application, the requirement for the applied trademark must be the same as the registered trademark or applied trademark that is the basis in the country. For details, please contact our office.
