商標の類否について

1．相談の内容
A社は食品にある商標を付けて販売したいと考え、商標の出願をしようとしたところ、他社の登録商標と称呼が類似していることが分かり、弊所へご相談がありました。

2．解決策
まず、商標の類似性を詳細に確認しました。今回の場合、A社の商標は他社と読み方が同じではあるものの、意味が異なり、ロゴが付いています。この場合、商標全体の類似性が低くなる可能性があります。

もう一つの方法として、指定商品、指定役務が重複していない範囲で、登録を試みることもできます。他人の登録商標と指定商品・役務が異なる場合、商標登録が認められる可能性があるためです。

3．結論

Another method is to try to register the trademark to the extent that the designated goods and designated services do not overlap. This is because if the designated goods and services are different from those of another person's registered trademark, the trademark registration may be approved.
