1．相談の内容
株式会社A社から、自社が開発した製品Bが、先行登録実用新案や先行登録意匠に抵触しないかどうか、お問い合わせがありました。
2．解決策
株式会社A社が開発した製品Bは、技術Cと技術Dを組み合わせたもので、先行登録実用新案が存在するかどうか、j-platpatでキーワード検索を行いました。キーワード検索の結果、技術Cと類似する内容の先行技術が検索され、また、技術Dと類似する内容の先行技術が検索されました。また、IPC検索を行いました。IPCとは国際的に統一された特許分類のことです。その結果、製品Bは、技術Cと技術Dを組み合わせたものなので、先行技術に対して進歩性がないので、有効な実用新案権として取得できる可能性は低いと考えました。
一方、製品Bは、形状に特徴があったため、先行登録意匠が存在するかどうか、j-platpatでキーワード検索を行いました。その結果、製品Bと類似の形状を持つ先行登録意匠が検索されたため、意匠権の取得の可能性は低いと考えました。

Prior search for registered utility models and registered designs
1. Content of the consultation
Company A Co., Ltd. inquired about whether product B developed by the company infringes on a previously registered utility model or design.
2. Solution
Product B developed by Company A Co., Ltd. is a combination of technology C and technology D, and a keyword search was conducted on j-platpat to see if there was a previously registered utility model. As a result of the keyword search, prior art similar to technology C was found, and prior art similar to technology D was also found. In addition, an IPC search was conducted. IPC is an internationally unified patent classification. As a result, since product B is a combination of technology C and technology D, it is not inventive over the prior art, and it is considered unlikely that it will be possible to obtain a valid utility model right.
On the other hand, product B had a distinctive shape, so a keyword search was conducted on j-platpat to see if there was a previously registered design. As a result, a previously registered design with a shape similar to product B was found, so it was considered unlikely that a design right would be obtained.
