1．相談の内容
クライアントは、新規の装飾品に係る製品を販売したいと考えています。しかし、他社が類似の製品を販売しており、当該他社の権利侵害の恐れがあるとして、弊所に相談しました。
2．解決策
特許情報プラットフォームJ-PlatPatで、当該他社の登録商標及び意匠権を検索しましたが、当該製品に関する商標及び意匠は存在しませんでした。そのため、当該他社の権利侵害の恐れは無いと判断しました。
又、クライアントの製品名の商標登録の可能性を検討しました。同様に、特許情報プラットフォームJ-PlatPatで、当該製品名と同一又は類似する先行登録商標や商標出願を検索しましたが、該当するものはありませんでした。一方で、インターネット検索を行うと、装飾品の分野で、当該製品名は、普通名称として用いられていることが分かり、商標登録は難しいと判断しました。

3．結論
新製品を開発したり販売したりする際には、他社の知的財産権を侵害していないかを調査する必要があります。又、新製品のデザインや製品名等に新規性があれば、意匠権や商標権を取得し、他社による模倣を防止することも考えられます。弊所では、知的財産に関する相談を承っております。お気軽にご相談ください。

1. Content of the consultation
The client wants to sell a new decorative product. However, another company is selling a similar product, and there is a risk of infringing the rights of that company, so he consulted us.
2. Solution
We searched for the registered trademarks and design rights of the other company on the patent information platform J-PlatPat, but there were no trademarks or designs related to the product. Therefore, we determined that there was no risk of infringing the rights of the other company.
We also considered the possibility of trademarking the client's product name. Similarly, we searched for prior registered trademarks and trademark applications that were identical or similar to the product name on the patent information platform J-PlatPat, but there were no matches. On the other hand, an Internet search revealed that the product name is used as a common name in the field of decorative products, and we determined that trademark registration would be difficult.

3. Conclusion
When developing or selling a new product, it is necessary to investigate whether it infringes the intellectual property rights of other companies. In addition, if the design or name of a new product is novel, it may be possible to obtain design rights or trademark rights to prevent other companies from copying it.
