特許表示の意味について

1．相談の内容
クライアントは、新規にカバーを製作し、このカバーに関して何らかの権利取得ができないかと考え、弊社に相談されました。
2．解決策
特許庁の特許情報プラットフォームJ-PlatPat及びインターネット検索により、類似の製品や技術が存在するかを調査しました。その結果、特許権・実用新案権の検索では、類似の技術は見つからず、意匠権の検索でも、類似の意匠は見つかりませんでした。又、インターネット検索でも類似の製品は見つかりませんでした。そのため、クライアントのアイデアに新規性はあると考えられ、実用新案権又は意匠権の取得は可能であると判断しました。
一方で、類似のアイデアが無かったため、このカバーに、市場ニーズがあるのか否かを調査し、権利化の意義について確認する必要があると提案しました。

3．結論
新規のアイデアで権利取得するには、まず先行文献調査を行い、新規性があるかどうかを調べる必要があります。又、権利化の見込みがあっても、ビジネスに繋がらなければ、意味がないため、市場ニーズ等を調査する必要があります。弊所では、権利取得のための先行文献調査を行っております。お気軽にお問い合わせください。

1. Content of the consultation
The client was thinking of making a new cover and obtaining some rights for it, so he consulted us.
2. Solution
We investigated whether there were similar products or technologies using the Japan Patent Office's patent information platform J-PlatPat and an internet search. As a result, we found no similar technologies in the patent and utility model search, and no similar designs in the design search. We also found no similar products in the internet search. Therefore, we determined that the client's idea was novel and that it would be possible to obtain a utility model or design right.
However, since there were no similar ideas, we suggested that we should investigate whether there was a market need for this cover and confirm the significance of obtaining a right.

3. Conclusion
To obtain rights for a new idea, you must first conduct a prior literature search to determine whether it is novel. Even if there is a possibility of obtaining rights, if it does not lead to business, it is meaningless, so it is necessary to research market needs, etc. Our firm conducts prior literature research for obtaining rights.
