新規性喪失の例外について

1．相談の内容
A社は健康関連製品の新商品を開発し、意匠権の申請を希望され、弊所に問い合わせがありました。

2．解決策
意匠申請にあたり、調査を進めたところ、出願する前に既にA社は展示会出展のためにウェブサイトにて新商品を公開していたという事実が判明しました。そのため、今回は、新規性喪失の例外の適用を受けるために、公開事実を記載した証明書を作成し、提出をすることになりました。
新規性喪失の例外とは、特許出願、実用新案登録出願や意匠の出願において、出願前に発明やデザインが公開されてしまった場合でも、その公開が一定の条件を満たす場合、新規性が失われたとみなされず、発明やデザインの登録が可能となる制度です。詳しくは下記の特許庁のページをご参照ください。

3．結論
　万が一、創作者自身が、展示会やカタログ、ウェブサイトやSNSで発表し、すでに販売を始めてしまっていた場合でも、新規性喪失の例外規定の適用手続きを行うことで、特許や意匠の保護を受けられる可能性があります。意匠登録の申請について、お困りの方はぜひ弊所までご相談ください。

Exceptions to loss of novelty

1.Content of the consultation
Company A developed a new sports-related product and contacted our office with a desire to apply for a design patent.

2. Solution
When we investigated the design application, we found that Company A had already released a new product on its website for exhibition prior to the filing of the application. Therefore, in order to apply for the exception to loss of novelty, we decided to create and submit a certificate stating the fact of disclosure.
The exception to loss of novelty is a system in which, even if an invention or design is disclosed prior to filing of a patent application, utility model registration application, or design application, if the disclosure meets certain conditions, it is not considered to have lost novelty and the invention or design can be registered. 3. Conclusion
Even if the creator himself has already announced the design at an exhibition, in a catalog, on a website or on social media, and has already started selling it, he or she may still be able to obtain patent or design protection by applying for exceptions to loss of novelty.
