1．相談の内容
A社は、食料品について新しい商品の発売を準備しています。A社は、新しい商品について商標登録出願のご希望があり、お問い合わせがありました。
2．解決策
まず、商標登録できるかどうかの調査を行いました。具体的には、特許庁の特許情報プラットフォーム（J-PlatPat）を用いて、類似する商標が既に登録されていないかを調査しました。
今回の場合、「●●●＋指定商品名」という組み合わせの商標でしたので、●●●をつけることで識別力が生まれるかどうかを過去の登録商標のデータから調査しました。
その結果、指定商品名だけでは識別力はないが、●●●を付けることで、「●●●＋指定商品名」は識別力があるということが分かりました。
クライアント様には「●●●＋指定商品名」で登録することをお勧めしました。

3．結論

Regarding trademarks that include designated product names
1. Content of the consultation
Company A is preparing to launch a new food product. Company A has contacted us with a request to file a trademark registration for the new product.
2. Solution
First, we investigated whether the trademark could be registered. Specifically, we used the Japan Patent Office's Patent Information Platform (J-PlatPat) to check whether similar trademarks had already been registered.
In this case, the trademark was a combination of "●●● + designated product name," so we investigated data on past registered trademarks to see if adding ●●● would create distinctiveness.
As a result, we found that the designated product name alone is not distinctive, but by adding ●●●, "●●● + designated product name" becomes distinctive.
We recommended that our client register "●●● + designated product name."
