商標の識別力の調査

1．相談の内容
株式会社A社は、名称Bの商標出願を検討しています。名称Bの商標出願が可能かどうか調査してほしいと、弊所にお問い合わせがありました。

2．解決策
まず、名称Bが、商標登録出願がなされているかどうかj-platpatで称呼検索を行いました。その結果、名称Bで先行出願されている商標は、拒絶査定であり、その内容を見ると、特許庁は、名称がBについて識別力はないと判断されていました。
そこで、名称Bに、他の文字や記号Cをつけて、j-platpatで称呼検索を行ったところ、全く検索されなかったため、名称Bに他の文字や記号Cをつけた商標は、識別力があると、助言しました。

第三条
1　自己の業務に係る商品又は役務について使用をする商標については、次に掲げる商標を除き、商標登録を受けることができる。
三　その商品の産地、販売地、品質、原材料、効能、用途、形状（包装の形状を含む。第二十六条第一項第二号及び第三号において同じ。）、生産若しくは使用の方法若しくは時期その他の特徴、数量若しくは価格又はその役務の提供の場所、質、提供の用に供する物、効能、用途、態様、提供の方法若しくは時期その他の特徴、数量若しくは価格を普通に用いられる方法で表示する標章のみからなる商標

Investigation of the distinctiveness of a trademark

1. Content of the consultation
Company A is considering filing a trademark application for name B. They contacted us to investigate whether a trademark application for name B is possible.

2. Solution
First, we performed a phonetic search on j-platpat to see if a trademark registration application for name B had been filed. As a result, the trademark previously applied for with name B was rejected, and the contents of the rejection decision showed that the Japan Patent Office determined that name B was not distinctive.

So, we performed a phonetic search on j-platpat with other characters or symbols C added to name B, but no results were found at all, so we advised them that a trademark with other characters or symbols C added to name B is distinctive.
